There are two main types of domestic agreements: a Separation Agreement, and a Prenuptial Agreement.
A Separation Agreement is used to divide any property that you and your spouse have acquired, as well as any debts incurred over the course of the relationship. A Separation Agreement also provides for the custody, access arrangements and child support of any minor children of the relationship. I work closely with my clients to prepare a Separation Agreement that identifies the specific requirements ideal to settle their property and custody issues prior to a getting a divorce.
A Prenuptial Agreement is a written contract between two people who are planning to get married. This agreement settles out the terms of possession of their assets, treatment of future earnings, and division of property should they ever separate. These agreements are fairly common if either or both parties have substantial assets, children from a prior marriage, potential inheritances, high incomes, or if either of the parties have been through a prior divorce.
